Technology Transfer
The Intellectual Property Officer at South Dakota State University is Kevin Kephart, PhD, VIce President for Research (SAD 130, 605-688-5642). Any discovery or invention having potential intellectual property value must be reported to the Intellectual Property Officer.
The goals of technology transfer activities at SDSU are to:
Identify and protect intellectual property developed at SDSU
Implement Board of Regents and Federal policies relevant to intellectual property
Generate revenue for the University and the creators of intellectual property at SDSU
Ensure public benefit from SDSU research
Provide legal and technical assistance on intellectual property issues
Approve material transfer agreements

Policies & Procedures Related to Intellectual Property

SDSU intellectual property activities operate under the South Dakota Board of Regents policies.

Disclosure of Intellectual Property
|
|
If a faculty or staff member believes that s/he has made a discovery or invention that may meet the definition of intellectual property, the employee should meet with the Vice President for Research to indicate the nature of the discovery. At this meeting, a preliminary determination will be made as to whether or not intellectual property may be involved and if a disclosure of intellectual property form should be completed. Following appropriate review, joint decisions will be made on the appropriateness of patenting or copyrighting the discovery or invention.

Confidentiality Agreements
|
|
Before discussing information that may be the basis of a patent or copyright with individuals or entities (other than the developers and the technology transfer office on campus), a confidentiality agreement should be signed. Only the Vice President for Research (Kevin Kephart) or the Associate Vice President for Research (John Ruffolo) are authorized to sign such agreements for the University.

Material Transfer Agreements
|
|
A Material Transfer Agreement must be completed and approved by the Vice President for Research (Kevin Kephart) or Associate Vice President for Research (John Ruffolo) prior to the transfer of any materials, whether or not they may have intellectual property value.

Bayh-Dole Act
|
|
Technology transfer at universities is strongly influenced by the Bayh-Dole Act (1980) and subsequent federal regulations implementing patent and licensing policy. Under the Bayh-Dole act universities (a) come under a uniform federal patent policy, (b) are permitted to retain title to inventions made under federally funded research programs, and (c) must ensure that those inventions are transferred to the private sector and commercialized expeditiously.

Entrepreneurship
|
|
One of the aims of South Dakota State University is to promote economic development in the region, state, and beyond through the facilitation of entrepreneurship activities of staff and students. Employees interested in entrepreneurial development of work-related activities must work with SDSUs technology transfer office in AD 130. In addition, the following organizations may provide assistance and information.

The Enterprise Institute was formed by the SDSU Foundation in May 2001 as a separate, non-profit corporation with its own 501(c)(3) designation from the Internal Revenue Service. The Enterprise Institute facilitates SDSU and industry resources to encourage and assist the establishment of entrepreneurial growth enterprises in the region.
