ARTICLE I - Name and Location
Section 1:
This Council shall be known as the South Dakota State University (SDSU) Career Service Advisory Council.

Section 2: The representative location of this Council shall encompass the campus of SDSU, Brookings, South Dakota, and all departments or units who have Career Service employees assigned to SDSU but working at a location other than the SDSU campus.

ARTICLE II - Objectives
Section 1:
The The Career Service Advisory Council is an elected body through which the Career Service employees express their concern for the welfare of the University Community, develops and disseminates ideas for University improvement, stimulates communication, contributes to the formation of general University policy, and performs those duties and functions especially allocated to or assumed by the Career Service employees, subject to the limitation imposed by the laws of South Dakota and the rules of the Board of Regents.

Section 2: The objectives of this Council shall be to improve communication between Career Service Employees and South Dakota State University administrative divisions; to discuss and make recommendations to the President on conditions of employment, fringe benefits, and other policies; to discuss issues and concerns of the Career Service Employees; and to offer the opportunity for administrative staff to explain and interpret rules, regulations, and policies of governmental units which have an impact on Career Service employees.

ARTICLE III - Membership
Section 1:
To be eligible for membership on the Career Service Advisory Council a person must be a permanent Career Service Employee in good standing.

Section 2: A Career Service Employee is defined as an employee holding a Career Service Act classification.

Section 3: There shall be eight (8) Council members elected from their respective areas as follows:3 - Administrative and Clerical
1 - Agriculture Services, Nutrition/4-H Assistants
2 - Technical and Health Services
1 - Custodial
1 - Maintenance and Security

Section 4: The term of office of each council member shall be two (2) years. Expiration of term of office is at the close of the January meeting. New members of the Council shall assume office with full voting privileges at the January meeting of the Council following their election.

Section 5: A member may be elected for no more than two (2) consecutive terms.

ARTICLE IV - Nomination and Election
Section 1:
The general election shall occur each year between 20-35 days prior to the end of the calendar year on a date designated at least 60 days prior to said election by the Election Committee.

Section 2: At least six weeks prior to the general election, all career service employees will be informed of the upcoming election and the resulting vacancies on the Career Service Advisory Council. Any employee wishing to be a nominee and be included on the ballot in their electoral unit will contact the election representative; their name will then be placed on the ballot. There will be no limitation on the number of nominees per election ballot.

Section 3: At least two weeks prior to the general election, the Election Committee shall mail to each eligible Career Service employee a general election ballot which lists alphabetically the names of the nominated individuals from his/her electoral unit according to the applicable criteria for the seat(s) to be filled. The completed ballot shall be delivered to the election representative no later than 5:00 p.m. on Election Day. All ballots returned after that time shall be declared void. Persons receiving the largest number of votes in each classification shall be declared elected. Tie votes shall be decided by special election in that electoral unit.

Section 4: : A vacancy in the Career Service Council shall be filled by the Council from the electoral unit in which the vacancy occurred by Executive Committee appointment. The appointee shall fill the remainder of that term of the council member being replaced. If an appointee is not found, no less than two attempts should be made to contact all members within the electoral unit in which the vacancy occurred, notifying members of said vacancy. If after above mentioned contacts an appointee is not found, the Executive Committee may fill the vacancy with an appointee from another electoral unit.

ARTICLE V - Officers
Section 1:
At the first meeting after the general election, the Council shall elect from its membership a Chairperson, who shall act as the presiding officer, a Vice-Chairperson, a Secretary, a Treasurer, a Historian and such other officers as it shall deem necessary. The Council, for this one purpose only, the election of officers, shall be defined as the current Council plus the newly elected Council members. Outgoing members are not eligible to be elected to Council office positions. A successful candidate for any Council office or elected committee must receive a majority of the votes of the entire Career Service Council membership.

Section 2: In the absence of the Chairperson, the Vice-Chairperson shall preside; in the absence of the Vice-Chairperson, the Secretary shall preside.

Section 3: The terms of the Council officers shall be one year. Terms begin at the close of the meeting at which they are elected.

ARTICLE VI - Committees
Section 1:
The Committees of the Council shall include an Executive Committee, a Committee on Elections and other such committees as the Council shall deem necessary.

Section 2: The Executive Committee shall consist of the Chairperson of the Council, Vice Chairperson of the Council, Secretary of the Council, Treasurer of the Council, and Historian of the Council. The Committee shall implement Council recommendations. The Executive Committee shall act as a liaison between the Council and the administration of the University. Upon a majority vote of the Committee, it shall call special meetings of the Council.

Section 3: The Committee on Elections shall consist of one member from each electoral unit where the vacancy occurs and shall supervise the nominating and the election of members of the Council.

Section 4: Each Committee shall be composed of at least three members and shall serve for a term of one year, or until assignment is completed. All committee members shall be appointed by the Chairperson of the Council and be subject to removal by the Chairperson. Each committee shall be responsible to the Council Chairperson and shall make such reports as the Chairperson may direct.

Section 5: The membership of each committee shall not be limited to council members, except for the Executive Committee.

ARTICLE VII -Conduct of Meetings
Section 1:
Authority for the Conduct of Meetings - The parliamentary authority for any matter not covered in these Bylaws shall be the most recent edition of Robert's Rules of Order.

Section 2: Passage of all main motions requires a majority vote of the total council membership. The vote required for passage of all other motions may be as prescribed in the most recent edition of Robert's Rules of Order.

Section 3: A quorum shall consist of two-thirds of the members of the Council and no meeting shall be official unless a quorum is present.

Section 4: A proxy shall be recognized only if a council member notifies the Secretary of the Council of the name of the proxy holder at least 24 hours before the scheduled meeting of the Council. A proxy holder must be a current member of the Council with full voting rights.

Section 5: Meetings of the Council shall be open to all Career Service employees, without exception, but voting shall be limited to Council members.

Section 6: The council may, by a vote of sixty percent (60%) of members present, go into closed session when discussion of personnel or other matters necessitate doing so.

Section 7: Additional meetings shall be called by the Executive Committee of the Council when a majority of the Council membership petitions for such a meeting or if the Executive Committee deems it necessary.

Section 8: Prior to a scheduled Career Service Advisory Council meeting, Council members shall notify the Chairperson of any intended absence(s). Three (3) unexcused absences will be cause for dismissal from membership on the Council.

ARTICLE VIII - Agenda
Section 1:
The agenda shall be set by the Chairperson and/or Council and distributed five (5) days prior to each council member before such meeting. Any Career Service employee may request an item be placed on the agenda by making his request 10 working days prior to the next scheduled meeting.

Section 2: Late items may be added to the agenda. The agenda must then be approved by a majority vote of the council prior to the beginning of the business portion of the scheduled meeting. Action taken on such items, however, shall be subject to reconsideration at the next regular meeting of the Council if a request for such action is presented to the Chairperson in time to have the items appear on the printed agenda for the meeting.

ARTICLE IX - Reporting Council Actions
Section 1:
The Secretary of the Council shall distribute the minutes of each Council meeting to each Council member within two weeks after the meeting.

Section 2: The Secretary of the Council shall place one copy of the minutes of each Council meeting in the Reserve Room of the University Library within two weeks after the meeting for use by any interested person.

Section 3: The Secretary of the Council shall forward a copy of all Council minutes to the President of the University. Copies are also sent to the Vice President for Academic Affairs, Vice President for Administration, Budget Officer and Director of Personnel.

ARTICLE X - Amendments and Revisions
Section 1:
Revision of these Bylaws shall be accomplished by approval of the University President and approval by at least six (6) members of the Career Service Advisory Council.

Section 2: Amendments to these Bylaws may be proposed either by the Career Service Employees or the Council. Amendments may be proposed by the Career Service Employees by submitting to the Council Executive Committee a petition containing the signatures of twenty-five (25) Career Service Employees.

Section 3: Amendments may be proposed by any member of the Council but must be approved as an amendment by a two-thirds vote of a quorum of Council members.

Section 4: All proposed revisions and amendments must be published in the minutes of the Career Service Council at least 30 days prior to any final approval action by the Council.

ARTICLE XI - Representative to Regents Classified Employees Advisory Council Representative to Regents Classified Employees Advisory Council
Section 1:
Purpose of the Regents Classified Employees Advisory Council is to promote communications between the Board of Regents, Office of the Executive Director Higher Education, Council of Presidents and Career Service Employees through discussion of matters of concern to all parties; to discuss issues and exchange ideas to improve conditions of employment, fringe benefits or other concerns of Classified Employees within the Higher Education system.

Section 2: The Chairperson of the South Dakota State University Career Service Advisory Council, or his/her designee, shall represent SDSU on the Regents Classified Employees Council and shall vote as the official delegate from South Dakota State University.
